Course Outline:
Brief Introduction of Presenters

Slide Presentation of Underlying Principles of Direct Negotiations and Mediated Settlement Discussions. (7 Minutes)

Experiential Exercise in Direct Negotiations, Two Alternate Case Studies (Either: Kramer v. Stevens {Personal/Bus. Injury} or Samson v Pillar {Des. Error & Omiss. / Construction Defect} (30 Minutes)

Participants divided into groups (of 5 or 8, depending on case study selected)

Presentation of Case Overview Provided by Presenter.

Individual, one-page role play hand-outs given to each numbered participant.

Participants with identical numbers meet briefly to fortify roles.

Odd numbered participants given special confidential 'observation instructions'
by presenters.

Participants divided into groups of opposing parties to begin their ‘Negotiations’
-
Exercise Terminated, Participants Rejoin Peers. (20 Minutes)

Participants debriefed by presenters as to what “negotiation strategies” each utilized to further their party’s objectives & inquiry is made through group discussion as to where ‘Sticking Points’ were encountered where negotiations became stalled. (Sticking Points are simultaneously written in large letters onto presentation easels.) (8 Minutes)
