OVERVIEW

L.E.A.P.™ REPAIR STRATEGY

An Expedited Case Management Protocol for
Early Resolution of Construction Defect Cases

The Least Expensive, Acceptable, Permanent - Repair Strategy  (L.E.A.P.™)

is an early dispute resolution  protocol designed to reduce both time and cost inefficiencies typical in multi-party,

factually complex, Design and Construction Defect cases.

The L.E.A.P.™ Negotiation Approach has been specifically crafted for cases where parties determine that
favorable results can be achieved from a mediator-facilitated, direct-dialogue between Experts.

The L.E.A.P.™ Strategy works through a series of sequential, facilitated expert meetings that serve to
evaluate, confirm and, or eliminate alleged defects with their attendant mechanisms of failure. Plaintiffs
and Defendants utilize this approach to clarify agreed upon defects and repair strategies for ‘down-stream’
mediated negotiations. (See Copy of Confidentiality Agreement)

The L.E.A.P.™ Procedure enables the safe management of strategically sensitive information so that
parties' experts are able to reach consensus regarding the least expensive, acceptable, permanent repair
remedies available. The L.E.A.P.™ approach saves both time and expense because it focuses solely on the
informational steps necessary to achieve final resolution.

The L.E.A.P.™ Methodology reduces the time needed for resolution from an average of 16-24 months to
   as little as 3-7 months.

The L.E.A.P.™ Repair Protocol Mediator provides a real-time, step-by-step evaluation of ongoing
proceedings, thus, retrofiting procedures in specific response to each parties' articulated needs.

By Rigorously Maintaining Close Telephonic Communication Between Scheduled Sessions; parties
maintain access to critical information while the mediator prevents potential conflicts from arising which
  otherwise impede progress toward resolution.

Through Participation in Efficient, Ongoing Problem-Solving Sessions, parties, counsel and carriers
are better prepared to enter into final, non-binding mediated settlement discussions.

The L.E.A.P.™ Repair Protocol Provides Delineated Schedules for Each Expert-intensive Meeting,
ensuring direct coordination between each party and their specific issues, thus eliminating the costly
need to sit through prolonged discussions on other parties' issues.
